Please read these terms of use ("Terms") carefully before using the website located at https://trilogycare.com.au (the "Website") operated by Trilogy Care Pty Ltd (ABN 44 604 915 200) ("the Company", "us", "we", or "our").

By accessing the Website, you agree to be bound by these Terms. These Terms constitute a binding agreement between you and the Company and govern your use of the Website.

Intellectual Property

In these Terms, the term "Proprietary Content" means:

  • the Website;
  • all of its content (including all of the text, graphics, designs, software, data, sound and video files and other information contained in the Website, and the selection and arrangement thereof); and
  • all software, systems and other information owned or used by the Company in connection with the services offered through the Website (whether hosted on the same server as the Website or otherwise).

All Proprietary Content is the property of the Company or its licensors (as applicable) and is protected by Australian and international copyright laws. You must not reproduce, transmit, republish or prepare derivative works from any of the Proprietary Content, except as expressly authorised by these Terms or with the prior written consent of the Company or other copyright owner (as applicable).

You may download and print out content from the Website only for your own personal and non-commercial use and provided that you do not remove or modify any copyright, trade mark or other proprietary notices.

The Company's logo and the phrase "Trilogy Care" are trade marks of the Company. The look and feel of the Website (including all button icons, scripts, custom graphics and headers) are the trade marks, service marks and/or trade dress of the Company. These trade marks, service marks and trade dress may not be used, copied or imitated, in whole or in part, without the prior written consent of the Company.

Prohibited Conduct

In using the Website, you must not:

  • use any spider, robot, scraper, data mining tool or any other automated device, process or means to access, retrieve, index or copy any portion of the Website or its content;

Severability

The provisions of these Terms are severable and, if any provision of these Terms is held to be illegal, invalid or unenforceable under present or future law, such provision may be removed and the remaining provisions shall be enforced.

Disclaimer

  • To the maximum extent permitted by law, the Company and its officers, employees, agents, consultants, licensors, partners and affiliates (together, the "Released Parties"):
  • expressly disclaim all conditions, representations and warranties (whether express or implied, statutory or otherwise) in relation to the Website and any services purchased or obtained through the Website, including any implied warranty or guarantee of merchantability, fitness for a particular purpose or non-infringement; and

  • Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.

Aged Care Services

Trilogy Care is a registered provider under the Support at Home program. These Terms govern your use of the Website only. These Terms are distinct from, and do not form part of, any client Services Agreement entered into with the Company.

Your rights and obligations as a care recipient are governed by your individual Services Agreement, the Aged Care Act 1997 (Cth) and, from 1 July 2025, the Aged Care Act 2024 (Cth) and the Support at Home program rules (as applicable).

Nothing on the Website constitutes an offer to provide aged care services. Any aged care services provided by the Company are subject to a separate Services Agreement and the applicable legislative and regulatory framework.

Health and Medical Information

The Website does not provide medical, clinical or health advice. Any information about clinical services published on the Website is general in nature and does not constitute medical advice, a clinical assessment or a recommendation for any particular course of treatment.

You should consult a qualified health professional before making any health-related decisions. The Company is not liable for any health outcomes arising from reliance on information published on the Website.

Testimonials and Client Reviews

The Website may display testimonials or reviews from clients. These reflect individual experiences only and results may vary. Testimonials are not guarantees of a particular outcome or standard of care, and the Company does not warrant that all clients will have the same experience.

Pricing and Fees

Pricing information displayed on the Website (including any pricing calculator) is indicative only and subject to change without notice. Actual fees payable by a client are those set out in their individual Services Agreement.

Government subsidy amounts and individual contributions depend on assessments conducted by My Aged Care and the Department of Health and Aged Care, which are outside the Company's control. Where means-tested care fees or Basic Daily Fees apply, these will be determined by the individual's financial assessment.

Portal and Online Services

The Website may provide access to a client portal or other online services. Availability of the portal is not guaranteed and may be interrupted for maintenance or technical reasons.

You are responsible for maintaining the confidentiality of your portal login credentials. The Company is not liable for any unauthorised access to your account resulting from your failure to keep your credentials secure.

The portal may be updated, modified or discontinued at any time without notice.

Accuracy of Information

While the Company takes reasonable steps to ensure the accuracy of information on the Website, it does not warrant that the Website is free from errors or that information is current at all times.

The aged care regulatory environment is subject to frequent legislative and policy change. You should verify the currency of information with the Department of Health and Aged Care or My Aged Care before relying on it.

As a registered aged care provider, the Company is subject to oversight by the Aged Care Quality and Safety Commission. You may also direct complaints to the Commission by calling 1800 951 822 or visiting www.agedcarequality.gov.au.

Privacy

The Company collects, uses, holds and discloses personal information in accordance with its Privacy Policy, available at https://trilogycare.com.au/privacy

By using the Website, you consent to the collection and use of your personal information in accordance with the Privacy Policy. The Company handles personal information in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

The Privacy Policy forms part of these Terms. If there is any inconsistency between these Terms and the Privacy Policy in relation to the handling of personal information, the Privacy Policy prevails to the extent of the inconsistency.

Governing Law

These Terms will be governed in all respects by the laws of Queensland. The parties irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland and the courts of appeal from them.

Changes

The Company reserves the right to amend these Terms and any other policy on the Website at any time in its sole discretion and any such changes will, unless otherwise noted, be effective immediately. Your continued usage of the Website will mean you accept those amendments. We reserve the right, without notice and at our sole discretion, to change, suspend, discontinue or impose limits on any aspect or content of the Website or the services offered through the Website.

You may only vary or amend these Terms by written agreement with the Company.
